<p>SUBJECT: LAWSUIT FILED AGAINST NY SAFE ACT</p>
<p>Today, March 21, 2013, the lawsuit against the so-called<br />
NY SAFE act was filed. This suit has multiple plaintiffs.<br />

<p>We will be posting any developments as they occur.</p>
<p>As law-abiding citizens, and as safe and responsible gun owners, we are outraged at the efforts of Governor Cuomo, along with many members of the New York State Assembly and the New York State Senate, to take away our Second Amendment rights. We are challenging the SAFE Act because it is unconstitutional. The SAFE Act violates our fundamental right to keep and use arms for self-defense, and the defense of our loved ones and homes. The SAFE Act also deprives us of the right to use firearms for hunting and sport shooting. The SAFE Act deprives lawful gun owners and licensees of our property and hurts our businesses. </p>

<p>SUBJECT:  WESTCHESTER OPT-OUT FORMS FOR FOIL REQUESTS</p>
<p>Everyone is aware of the outrage over the dangerous, reckless and irresponsible publishing<br />
by the Gannett Journal News of the names and addresses of Westchester<br />
County pistol license holders.  </p>
<p>To prevent another incident, Westchester County, in order to comply with a provision of<br />
the recently passed &#8220;SAFE&#8221; law, has made available an &#8220;opt-out&#8221; form which will<br />
serve to remove an individual licensee&#8217;s information from any future Freedom Of Information<br />
Law (FOIL) releases.</p>
<p>Here is the statement from the County Clerk&#8217;s office:</p>

<p>Pistol Permit Holder “Opt-Out” Form Now Available<br />
The form on which a pistol permit holder can request that their name and address not be made public was<br />
released by the New York State Police on Friday, February 15, 2013.  The <a href="http://www.westchesterclerk.com/images/stories/pdf/Pistol/FOIL_Exemption_Form2013.pdf" title="FOIL opt-out form">form</a> will be mailed out to all active<br />
pistol permit holders in Westchester County. <a href="http://www.westchesterclerk.com/images/stories/pdf/Pistol/FOIL_Exemption_Form2013.pdf" title="opt-out form"> Opt-Out forms </a>should be mailed to The Office of the Westchester<br />
County Clerk, Attn:  Pistol Permit Unit, 110 Dr. Martin Luther King Jr. Blvd., White Plains, NY 10601.  Forms<br />
can also be hand-delivered to the office between the hours of 8 am and 5 pm, Monday through Friday, excluding holidays.<br />

<p>As stated, forms will be mailed to all pistol license holders.  Note that the completed form must still be<br />
reviewed by a &#8220;licensing officer&#8221;, which means a judge in a court, before being approved. </p>
<p>There is a moratorium on any FOIL releases of pistol license data for the next few months which will<br />
allow license holders time to get their opt-out forms submitted.</p>
<p>The opt-out form will also be available for download on our website, <a href="http://www.wcfoany.org/wp-content/uploads/2013/FOIL_Exemption_Form2013.pdf">FOIL Opt-Out Form</a> and as well<br />
can be downloaded from the links above to the Clerk&#8217;s site.</p>

SUBJECT: NOTICE OF CLAIM OF LAWSUIT FILED TODAY</p>
<p>The New York State Rifle and Pistol Association (NYSRPA), the Westchester County<br />
Firearm Owners Association (WCFOA), the Sportsmen&#8217;s Association for Firearm<br />
Education (SAFE) and AR-15.com.LLC have filed a Notice of Claim against<br />
the State of New York regarding the recently passed NY SAFE law.</p>
<p>As all gun owners no doubt know, this law was passed literally in the dark of<br />
night,  with no public notice, no public input or participation.<br />
Contrary to customary State protocol the bill was not held for public view<br />
for three days, but rather was rammed through the Legislature.  It is<br />
an outrage.  It contains flaws and errors and it is a disgrace.</p>
<p>By filing this lawsuit, the New York State organizations involved have made<br />
clear their intent, and the intent of their members, to fight this law on every<br />
level, and to take it, if necessary, to the United States Supreme Court.<br />
It is not an exaggeration to state that the future of gun ownership in New York State<br />
hinges on the outcome of this lawsuit.  In fact the future of gun ownership in the<br />
United States will be affected directly by the outcome of this New York lawsuit.</p>
<p>The move to disarm lawful firearm owners and strip them of their<br />
Constitutionally-recognized, individual right to lawfully keep and bear arms<br />
is a cancer.  It is a cancer that has taken root in, as Governor Cuomo<br />
stated in this State of the State address, &#8220;the Progressive capital of the country&#8221;,<br />
New York.  If this unconstitutional violation is allowed to stand it will<br />
undoubtedly spread.  We see signs of that already as President Obama and<br />
Vice-President Joseph Biden take their dog-and-pony anti-gun show on<br />
the road, countrywide, replete with the lies, distortions and falsehoods that<br />
always have characterized the citizen disarmament movement&#8217;s tactics.</p>
<p>The organizations that are plaintiffs in the lawsuit have committed to see this lawsuit<br />
through to its conclusion.  This means that the costs of the suit have also been<br />
committed.</p>
<p>Now is the time to &#8220;do something&#8221; by helping to fund this suit.  Those who can afford<br />
to make a donation to defray the costs of the suit can do so by going to<br />

<p>The publishing of the online, interactive &#8220;map&#8221; of New York pistol license holders&#8217; names and addresses continues to jeopardize tens of thousands of individuals and families &#8211; <strong>it must be taken down.</strong></p>
<p>Gannett&#8217;s ongoing persecution of lawful gun owners is a <strong>cancer</strong> that if left unchecked will surely spread across the country.  New York is the  &#8220;test case&#8221;, and we can expect  shortly to see similar actions on a national scale.</p>

<p>It is important that members and concerned citizens contact as many of these<br />
advertisers as possible.  A short letter which starts by quickly outlining the<br />
irresponsible Journal News act of publishing the names and<br />
addresses of pistol license holders (and a Google Maps<br />
picture with directions and family members names) would be best.</p>
<p>State that you will no longer patronize any advertiser who uses Gannett<br />
unless and until that advertiser withholds further ads until Gannett takes<br />
down the pistol license page and ceases attacking lawful firearm ownership.<br />
Particularly, contact advertisers with whom you already do business,<br />
and who may know you personally.</p>
<p>The Journal News has put in harm&#8217;s way tens of thousands of lawful license holders.<br />
This action by the Journal News can only be viewed as an attempt to<br />
intimidate and bully lawful gun-owning citizens.  The data posted also includes active<br />
and retired police, judges, battered and stalked individuals, FBI agents, and more.</p>
<p>The Journal News has made no credible case, nor any valid reason for releasing the data,<br />
and it serves no investigative or journalistic purpose.<br />

<p>SUBJECT:  CONTINUED HARASSMENT OF LAWFUL<br />
FIREARM OWNERSHIP BY JOURNAL NEWS</p>
<p>As most members are aware, the Journal News, the local Gannett newspaper,<br />
has again taken reckless and irresponsible action to further its unceasing<br />
attacks on legal, lawful firearm ownership.</p>
<p>Similar to what the Journal News did in 2006 when they published the database<br />
of all Westchester pistol licensees, the latest attack is an online, interactive<br />
map of Westchester (and other counties) with red dots on the addresses of<br />
pistol licensees.  It can be viewed on LoHud&#8217;s site:</p>

<p>The map can be expanded to show street detail, and using Google Maps the house  and<br />
surrounding terrain can be viewed.</p>
<p>Unfortunately the names and addresses of pistol license holders<br />
are a &#8220;public record&#8221;, and as such are available to anyone.  By openly publishing this data<br />
the Journal News has not only placed pistol licensees in jeopardy, but they have also needlessly<br />
endangered the safety of the general public.  In effect they have published a<br />
&#8220;shopping list for criminals&#8221;, who would otherwise not have access to such information.</p>
<p>It is clear that the Journal News intends to intimidate and endanger lawful pistol licensees.<br />
Besides showing what houses have licensed individuals, it also shows what houses<br />
DO NOT have pistol licensees &#8212; valuable information to criminals who do not want to<br />
chance facing armed citizens.</p>
<p>The Journal News recklessness extends even further.  The list contains the names of<br />
current and retired police officers, judges, attorneys and others who are exposed to serious<br />
threat by making it easy to locate and &#8220;case&#8221; their homes anonymously online.</p>
<p>Nearly every legislative session in Albany sees a bill introduced to make pistol license data private and<br />
confidential, much like medical and mental records, available only to those with valid legal reasons<br />
to access them.  However, it is the CITY-DEMOCRAT-CONTROLLED ASSEMBLY<br />
that refuses to pass this common-sense law.  Their inaction, or rather their willful action against these<br />
privacy proposals, speaks volumes about their true intent towards legal, lawful firearm ownership.</p>
<p>Other states that saw pistol license information published did in fact make their databases confidential<br />
and thereby stopped such irresponsible action.</p>
<p>The reaction to this latest outrage has been immediate and vehement.  The Journal News admits in<br />
today&#8217;s paper that the response has been &#8220;The overwhelming majority of comments strongly object to the article&#8221;.<br />

<p>The New York State Rifle and Pistol Association has alerted its members and is utilizing its<br />
phone bank to assist firearm owners in contacting the Journal news to register their displeasure<br />
and to organize a boycott of the Journal News and its advertisers.</p>
<p>For now the most effective steps you can take are to:</p>
<p>1) write the Journal News and condemn them &#8212; and cancel your subscription</p>
<p>2) write or call your elected state representatives and demand that they pass a law making pistol license<br />
databases confidential.  The public safety cannot be compromised by reckless anti-gun<br />
zealots such as the Journal News staff whose bias overrides any concern for the safety of lawful<br />
citizens</p>
<p>3) write to the Journal News ADVERTISERS and tell them that effective immediately you will refuse<br />
to patronize them unless and until they pull their ads from the Journal News.</p>
<p>One last legal activity which emphasizes that &#8220;turnabout is fair play&#8221; is to &#8220;out&#8221; all of the management<br />
and staff at the Journal News.  Their personal information, too, is online for everyone to see.<br />

<p>We will have other anti-gun issues to address during the coming year.  We need to<br />
put the anti-gun zealots and victim disarmament proponents on notice that we don&#8217;t intend<br />
to sit quietly on the sidelines while our rights are violated and the personal safety of ourselves and<br />
our families is threatened by the reckless political acts of cowards.</p>
