Opt-out forms now available for future pistol license FOIL releases

SUBJECT: WESTCHESTER OPT-OUT FORMS FOR FOIL REQUESTS

Everyone is aware of the outrage over the dangerous, reckless and irresponsible publishing
by the Gannett Journal News of the names and addresses of Westchester
County pistol license holders.

To prevent another incident, Westchester County, in order to comply with a provision of
the recently passed “SAFE” law, has made available an “opt-out” form which will
serve to remove an individual licensee’s information from any future Freedom Of Information
Law (FOIL) releases.

Here is the statement from the County Clerk’s office:

Pistol Permit Holder “Opt-Out” Form Now Available
The form on which a pistol permit holder can request that their name and address not be made public was
released by the New York State Police on Friday, February 15, 2013. The form will be mailed out to all active
pistol permit holders in Westchester County. Opt-Out forms should be mailed to The Office of the Westchester
County Clerk, Attn: Pistol Permit Unit, 110 Dr. Martin Luther King Jr. Blvd., White Plains, NY 10601. Forms
can also be hand-delivered to the office between the hours of 8 am and 5 pm, Monday through Friday, excluding holidays.

As stated, forms will be mailed to all pistol license holders. Note that the completed form must still be
reviewed by a “licensing officer”, which means a judge in a court, before being approved.

There is a moratorium on any FOIL releases of pistol license data for the next few months which will
allow license holders time to get their opt-out forms submitted.

The opt-out form will also be available for download on our website, FOIL Opt-Out Form and as well
can be downloaded from the links above to the Clerk’s site.
